Cannabis and Tourism in Nevada: Legal Limits, Safe Use, and Restrictions

Nevada permits adults 21+ to purchase cannabis only from state-licensed retail stores after presenting valid government ID. Private sellers and unlicensed pop-ups are illegal, and owners of private property (including hotels and short-term rentals) may prohibit possession or use on their premises. Always confirm house rules before you book.

Possession and purchase limits increased in 2024. Tourists (like residents) may lawfully possess up to 2.5 ounces of usable cannabis and up to ¼ ounce of concentrates. Nevada implemented these higher limits by statute (SB 277, 2023); the state regulator’s public guidance reflects the same thresholds and includes equivalency charts for non-flower products.

Where you can—and cannot—consume is the most common source of trouble for visitors. Consumption in public places (streets, parks, casinos, hotel lobbies, and most event venues) is illegal. Use in a moving vehicle is also prohibited, even for passengers. Consumption is lawful on private property only if the owner hasn’t banned it, or inside a state-licensed cannabis consumption lounge. Before lighting up, confirm the venue’s policy; gaming properties remain off-limits.

About lounges: Nevada authorizes both retail-attached and independent cannabis consumption lounges, with detailed operating rules (e.g., single-use/ready-to-consume products and on-site consumption only). Availability is growing but still limited and can change; check city and state resources for current options before you go.

Driving and transportation: Nevada enforces DUI laws for cannabis. Officers assess impairment, and the state’s safety campaign highlights that any use can impair; Nevada’s DUI statute sets per-se limits for delta-9 THC. If you’ve consumed, use rideshare or a sober driver. Do not consume in a vehicle; keep products sealed and out of reach until you arrive at a lawful location.

Federal law still matters. You may not carry cannabis onto federal lands (e.g., Lake Mead, Red Rock) or across state lines—including at the airport. Nevada regulations require warnings that products may be unlawful outside the state, and regulators expressly prohibit transport across state lines. Plan to consume or properly dispose of any remaining product before departing Nevada.
